DUNDEE WOMAN'S ACTION
Sheriff Malcolm at Dundee to-day heard proof in an action by Mrs Grace Fothringham, 32 Caldrum Street, against her husband, Peter Fothringham, hawker, 54 Jamaica Street. Pursuer asked for warrant to imprison, in respect of defender's wilful failure to pay sums of aliment for which decree was granted at the rate of 7s 6d per week December, 1927. Mr L Weir, solicitor, appeared tor pursuer and Mr David Reid, for defender. Peter Fothringham (53), 54 Jamaica Street, said his occupation was selling firewood on his own account. His profit amounted to 6s to 7s per day. He paid 5s per day for horse and cart. Business was not good in the meantime, he found it impossible to pay the amount under decree granted against him. He offered 3s, but this was refused. Teetotal Since Last Week. Answering Mr Weir, witness said that since decree was granted he had been paying approximately 4s week. He could not pay any more, because sometimes he could not get a horse. The man from whom he hired his horses was a dealer and sometimes was unable to give him a horse. Witness said he disposed of his own horse about two-and-a-half years ago. Mr Weir —You had a horse about two or three weeks ago?—l have a strange horse three or four times a week. Mr Weir —Are you teetotal?—No, not quite. I have been this while back of course. Mr Weir —Since when ?—Since last week. (Laughter.) Have you ever been drunk? —Yes. When was the last occasion? —Two or three weeks ago. Witness said he never got a regular diet of meat. Is it the case you were convicted for drunkenness in December last ?—Yes. You deny that you had a considerable amount of whisky the day you came to see me? —There was a man home from India that day. I saw him on the High Street before I came up. Weather Effects. Witness added that if he took a half of whisky he had to want his meat. Under further examination witness said that people did not use their fires for cooking in this weather. Gas stoves were used. They even had gas in washing houses nowadays. When he couldn't get rid of wood when he was nearly finished he in washing houses nowadays. It was full up to the top. They saw it return empty. When defender lived with witness he used to make £5 to £6 per week. Mrs Grace Fotheringham or Cook, daughter of the previous witness. corroborated. Fortification. Addressing Sheriff Malcolm, Mr Weir referred to defender's visit to his office prior to which he had apparently been drinking. Sheriff —He had to fortify himself to meet you. A. J. Findlay, sheriff clerk depute — Boarding the lion in his den. (Laughter.) Sheriff Malcolm said he was not satisfied with defender's evidence and was prepared to grant warrant. Unless he made an offer which the other side was prepared to accept, he would have to go to prison.

Think this is them again. Strathmartine Rd was mentioned in the assault of Bridget.
" Before Bailie Doig in the Police Court yesterday - Peter Fotheringham, millworker, Hospital Wynd, was charged with assaulting Constable Mennie while in his house on Sunday morning. He pleaded not guilty. It appeared from the evidence that accused wife accosted two constables in Strathmartine Rd, and complained that her husband had assaulted her and put her out of the house. She was almost naked and had a child 4 months old in her arms. The constables accompanied her to the house. Accused, who was sitting by the fireside, received the police with curses, told them they had no right there, and sprang at Mennie and struck him a blow on the face.A fine of 30s or 20 days in prison was imposed."

he was a mill foreman sentenced to 15 days imprisonment for quarrelling with his wife about some fish which had been bought by their daughter in law for supper. The quarrel led to him assaulting his wife.

"Grace Allan or Fotheringham (49) 43 North Street and her husband Peter Fotheringham (52) firewood vendor were each fined £1 or 10 days on charges" of assault. Bridget Campbell or Fotheringham was a daughter in law assaulted firstly by Grace and then by both of them. Seemingly there had been trouble between Grace and Bridget and Peter was "just trying to seperate them and keep the peace." Both were the worst for liquor.
