Annie,

A few years ago I had a girl who just happened to get pregnant 6 weeks after her employment began.

I had to jump through hoops to get her through to 6 weeks prior to the expected birth date. All that with no loss of income although her production in the end was zilch! I can't begin to tell you everything that had to be put in place, even to the detriment of other employees.

Your daughter's employers are being unreasonable and I can understand why, cos pregnant staff are a pain...lol That doesn't mean they should get away with it. Her HOD has to address her health issues without compromising her rate of pay.

If you want any help just pm me :-))

My OH works disturbed shifts, he has to have 12 hours between reporting. This is a copy regulation which should apply unless her contract states otherwise. However, when you employ a woman that becomes pregnant the employer has a duty to do everything possible to keep that woman employed in some capacity without prejudice to either her health or the baby's. It's not complicated and her employer will know the regulations, they are being unreasonable. Get her to write and explain the circumstances and her wish to discuss a remedy with her HOD.

Sue

The legal number of hours between shifts is determined by the Working Time Regulations 1998. They state that the minimum rest period in a 24-hour period should not be less than eleven consecutive hours. In brief, workers are entitled to at least 11 hours rest per day, at least one day off each week and a rest break during the shift if it is longer than six hours. An employer cannot insist that a worker works more than 48 hours per week. Any more than 48 hours are voluntary and subject to an Opt Out agreement.

Note that for night workers, there is a maximum of 8 hours work in any 24 hours on average and a right to free health assessments.

Mobile workers are subject to a variation of these rules under the Road Transport (Working Time) Regulations that came into force last year.

Have you tried googling?

I googled pregnancy and law and found this info:

http://www.thompsons.law.co.uk/ltext/l1390001.htm

http://www.ivillage.co.uk/pregnancyandbaby/experts/Matrights/articles/0,,14_178591,00.html

There may be more.

By the looks of it, they really need to do a risk assessment.

Also has she thought about talking to Citizen's advice etc?

Has she got a Union rep that can support her? Or her doctor's support?

Can she ask to be referred to occupational health?
