we have a rule at work, no smoking in company cars, and no smoking in your car if you have another worker with you.

There are very few exemptions to the smoking ban.
The new law will affect most public premises,
including workplaces and work vehicles.
The exemptions are listed below:


Residential Accommodation
Designated rooms in adult care homes
Adult Hospices
Designated Rooms in psychiatric hospitals and psychiatric units
Designated hotel bedrooms
Detention or interview rooms which are designated rooms
Designated rooms in offshore installations
Private Vehicles

Penalties for not complying with the new smoking law

Failure to comply with the law will be a criminal offence.
Individuals may be fined a fixed penalty of £50 for smoking in no-smoking premises

Dont know if this helps but as i read it if you were in your own car you are allowed to smoke

Hi, i don't smoke, and i have to say as i'm asthmatic i hate being near smokers, but, if people want to smoke in their own private cars then it should be allowed, i take it the car was your/ work mates car? The only thing i can read from this is were you in works uniform,then it might be deemed ' a work' place. Sue

I was stopped on the way home from work today as me & work mate were smoking sat in traffic. Cops pulled me & told me that my car was a place of work & give me £50 fine, You couldnt make it up in this bl**dy country !!!!
